TERMS & CONDITIONS

1. INTRODUCTION

These Terms & Conditions (“Terms”) govern the use of the digital healthcare platform (“Platform”) operated by CureALife Healthtech Private Limited, located at 57 Bangur Park, 2nd Lane, Rishra, Hooghly, Kolkata, West Bengal – 712248, India.
Below website & mobile app are part of the Platform: www.CureALyf.com, patient.CureALyf.com, doctor.CureALyf.com and its other involved website or App.
By accessing or using our website, mobile app, clinician portals, organizational dashboards, APIs, AI tools, telemedicine systems and other integrated systems, platform & tools you agree to these Terms.

2. APPLICABILITY
  • Users of our platform

  • Patients

  • Doctors, nurses, physiotherapists, psychologists, dieticians, and other Clinicians or Medics

  • Clinics, hospitals, labs, diagnostics, pharmacies

  • Insurance companies, NGOs, corporates, research bodies

  • Medical colleges, institutions, and administrators

  • Third-party service providers and technology vendors

3. DEFINITIONS
  • “User” – Any person or organization using the Platform.

  • “Clinician or medic” – Verified healthcare practitioner registered on the Platform.

  • “Third-Party Provider” – Labs, pharmacies, insurance, diagnostic center, NGOs, corporates, technology providers, etc.

  • “AI Module” – CureALife’s artificial intelligence systems providing differential diagnosis, predictions, triage, and clinical decision support, etc.

  • “Services” refers to online medical consultations, appointment booking, health records, chat, audio/video consultations, diagnostic bookings, etc.

4. ELIGIBILITY

Users must be 18+ or under legal guardian consent. Clinicians or Medics must have valid medical licenses. Organizations must have valid business registration.

5. USER ACCOUNT

Users must provide accurate, up-to-date information and maintain confidentiality of login credentials. The Company is not responsible for unauthorized access caused by user negligence.

6. SERVICES PROVIDED

The Platform provides:

  • Telemedicine (chat, audio, video)

  • Appointment scheduling

  • Digital prescriptions

  • Lab & pharmacy booking & ordering

  • AI-based symptom analysis, differential diagnosis & predictions

  • Hospital & clinic management tools

  • Corporate, NGO & insurance integrations

  • Research & analytics (anonymized data)

The Company is NOT a hospital, clinic, or medical provider. Clinicians or Medics are solely responsible for medical care.

7. CLINICIAN OR MEDIC–PATIENT RELATIONSHIP

A relationship is formed only when a clinician or medic accepts a consultation. The Company only facilitates communication and data exchange.

8. AI MODULE – DISCLAIMER

Our AI tools provide:

  • Differential diagnosis suggestions

  • Predictive analytics

  • Treatment & management recommendations

  • Triage and risk scoring

AI output is informational only and NOT a substitute for clinical judgment. The Company is not liable for any clinical decisions based on AI.

9. TELEMEDICINE & THIRD-PARTY TOOLS

The Platform may use Jitsi Meet, WhatsApp, Hostinger, Azure, payment gateways, and other third-party technologies. Users acknowledge:

  • Each third-party has its own policies

  • The Company is not responsible for third-party errors, outages, or data breaches

10. PAYMENTS & FEES

Fees are displayed prior to booking or confirmation. Payments are processed via third-party gateways. Refunds follow the Refund Policy.

11. THIRD-PARTY SERVICES

The Platform integrates with labs, pharmacies, insurers, NGOs, corporates, hospitals, and others. The Company is not responsible for their quality, pricing, or delivery.

12. CONTENT & INTELLECTUAL PROPERTY

All logos, code, text, AI models, and materials belong to CureALife Healthtech. Users may not copy or distribute materials without permission.

13. USER OBLIGATIONS

Users agree not to:

  • Upload harmful, abusive, or illegal content

  • Use prescriptions fraudulently

  • Misuse health data

  • Interfere with platform functionality

Clinicians or Medics agree to:

  • Provide care responsibly

  • Maintain patient confidentiality

  • Not bind the Company legally

  • Use platform data only for treatment

14. LIMITATION OF LIABILITY

The Company is not liable for:

  • Medical negligence by Clinicians or Medics

  • AI inaccuracies or misinterpretations

  • Third-party service failures

  • Data leaks caused by third-party systems

  • Force majeure events

  • Losses or damages arising from medical decisions

Maximum liability is limited to the amount paid by the user.

15. TERMINATION

The Company may suspend or terminate accounts for:

  • Violating Terms

  • Fraud/abuse

  • Illegal activity

  • Security concerns

Users may raise a delete request by writing to support@curealyf.com for their account. We may still keep the data for 3 to 10 years or time period as required by the applicable law of the country.

16. DISCLAIMERS
  • Emergency Use: Not intended for emergency medical needs.

  • AI Support: Not a substitute for licensed medical professionals.

  • Liability: Individual providers are responsible for their advice.

17. MISCELLANEOUS:

A Party shall not be liable or required to perform any of its obligations (except for payment obligations) under this Agreement in the event of any contingency beyond the reasonable control of the Party, such as an act of God, flood, earthquake, war or national emergency, insurrection, any epidemic, and/or an act of terrorism and change in government policies.

18. GOVERNING LAW

These Terms are governed by Indian law. Jurisdiction lies in West Bengal, India.
